Terms of Service

1. Acceptance of Terms

By accessing or using AnnaConnect.art (“the Platform”), operated by Anna Arts Council, a 501(c)(3) nonprofit organization based in Anna, Texas, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform.

2. About the Platform

AnnaConnect.art is a membership-based arts marketplace that connects local artists in Anna, Texas and surrounding communities with buyers, businesses, and community members. The Platform is operated by Anna Arts Council, a tax-exempt nonprofit organization under Section 501(c)(3) of the Internal Revenue Code. Our mission is to support and promote local artists in communities where municipal arts infrastructure does not yet exist.

3. User Accounts

You may create an account as a Buyer, Artist, or Enterprise user. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information during registration. We reserve the right to suspend or terminate accounts that violate these terms.

4. Artist Memberships & Payments

Artists may subscribe to membership tiers (Free, Spotlight, Growth, or Creative Elite) to access platform features. Paid memberships are processed securely through Stripe. Artists retain 100% of their sales revenue — Anna Arts Council does not take commissions on direct artist sales. Membership fees support platform operations and the nonprofit's mission. Refund requests for membership fees may be submitted to [email protected].

5. Content License & Usage Rights

Artists retain full ownership of all artwork, images, descriptions, and other content they upload to the Platform. However, by creating an account and uploading content, you grant Anna Arts Council a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and create derivative works from your content for the following purposes:

• Platform Display: Showcasing your profile, listings, artwork, events, and services on the Platform and related websites
• Video Production: Featuring your profile, artwork, and content in promotional videos including but not limited to YouTube Shorts, Instagram Reels, Facebook Reels, TikTok videos, and any other video format for social media or digital marketing
• Marketing & Advertising: Using your profile, images, and content in marketing materials, social media posts, Google Ads campaigns, paid and organic advertising, newsletters, press releases, and promotional campaigns across all media channels
• Digital Magazine: Publishing your profile, images, artwork, stories, and related content in the AnnaConnect.art digital magazine and any future print or digital publications operated by Anna Arts Council
• AI-Generated Content: Using your profile data, images, and content to generate AI-assisted marketing materials, captions, descriptions, and promotional content on your behalf and for the Platform
• Community Showcases: Featuring your work in art sighting galleries, community spotlights, event promotions, and partnership materials
• Third-Party Integrations: Sharing your content through integrated third-party platforms including but not limited to YouTube, Facebook, Instagram, TikTok, Google, and print-on-demand services

This license continues for as long as your content remains on the Platform. Content that has been published in videos, magazines, or marketing materials prior to removal may continue to be used in those existing materials. You may request removal of your content from future use by deleting your account or contacting [email protected].

6. Communications Consent

By creating an account, you consent to receive communications from Anna Arts Council and AnnaConnect.art through the following channels:

• Email: Transactional emails (account verification, payment confirmations, profile approvals), promotional emails (artist features, event announcements, platform updates), and newsletter communications
• SMS/Text Messages: Account notifications, event reminders, marketing messages, and community updates (message and data rates may apply)
• Push Notifications: Platform alerts, feature announcements, and engagement notifications
• In-App Messaging: Direct messages from buyers, gallery inquiries, commission requests, and platform notifications

You may opt out of non-essential communications at any time by updating your notification preferences in your account settings or by contacting [email protected]. Transactional communications necessary for account operation cannot be opted out of while your account remains active.

7. Prohibited Conduct

You agree not to: (a) upload content that infringes any third-party intellectual property rights; (b) use the Platform for unlawful purposes; (c) attempt to gain unauthorized access to any part of the Platform; (d) harass, abuse, or harm other users; (e) upload malicious code or interfere with Platform operations; (f) create multiple accounts for deceptive purposes; (g) scrape or collect user data without consent.

8. Third-Party Services

The Platform integrates with third-party services including Stripe (payments), YouTube, Facebook, Instagram, TikTok (content publishing and marketing), Google (advertising and analytics), and cloud storage providers. Your use of these services is subject to their respective terms and privacy policies. Anna Arts Council is not responsible for the practices of third-party services.

9. Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, express or implied. Anna Arts Council does not guarantee uninterrupted access, error-free operation, or that the Platform will meet all your requirements.

10. Limitation of Liability

To the fullest extent permitted by law, Anna Arts Council and its officers, directors, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform. Our total liability shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

11. Modifications

We may update these Terms of Service from time to time. We will notify registered users of material changes via email or Platform notification. Your continued use of the Platform after changes are posted constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Collin County, Texas.
